I personally believe this is happening for several reasons. Think about it, there are a ton of venues out here that are making a lot of money weekly, some daily, by opening their doors. Many venues have major artists come through there spots and some have indie artists showing up as well. Now the indies can be looked at with the same importance as major artists. We’ve all heard the term, struggling artist. This is just another way for indie artists to get a sense of at least something coming from the constant hustle involved with writing and making music. It’s a step up for the Indies and I commend ASCAP for doing this.

Now, ASCAP also¬† knows about all of these venues raking in cash each week. I’m almost certain that the non-paying venue’s information came from their feelers out there keeping an eye on things. It’s probably a matter of coming down on venue owners even harder about royalties. What you may not know as an Indie artist is that these venues are supposed to be paying royalties to songwriters, composers and Publishers representing these songs. Based on ASCAP law, your music being streamed in any area is considered a public performance. The reason people sign up with ASCAP is so their music can earn these types of royalties from public performances. A public performance can be commercial radio play, music streaming on store intercom, music played in clubs, etc. And performance rights organizations like ASCAP help you track this information when registering your titles. It’s not like the Copyright Office with sending in the music. You will just be registering titles and listing the song information, songwriters/composers and the Publisher. ASCAP is definitely making a move on all venue owners that are not signed up with them to pay royalties. Venues ARE public performing these artist’s music, point-blank period! If an artist is paying these money hungry promoters just to perform, I think these venue owners should pay into performance rights organizations. At the end of the day the venues and the promoters are the ones walking away with the money and the artist away with false promises. Like an A&R from Def Jam Records will be there scouting for indies or a major artist is looking to sign indie artists. I know you’ve heard them all before. Well it’s pay-back time and ASCAP is helping make that happen. Look at this way, at least you’re not walking away with false promises. You’re now getting paid royalties from your efforts and ASCAP finds another venue that is not paying in. This is almost like Mafia tactics, you have to admit! But if this is what it takes for venues to do what they are supposed to do, then I’m all for it.
